CONFLITOS E RELAÇÕES DE PODERES ENTRE A JUSTIÇA E OS GÊNEROS SEXUAIS: O CRIME DE SEDUÇÃO DE MENOR DENTRO DA LITERATURA JURÍDICA BRASILEIRA – 1940-1990

Abstract

Este ensaio é parte de minha pesquisa de mestrado, a qual analisa, por meio de dezessete fontes processuais, arquivadas no acervo do Centro de Documentação e Apoio a Pesquisa ? CEDAP, situado na UNESP/ Assis-SP, o crime de sedução de menores ocorrido entre 1940, com o advento do Código Penal, até o ano de 1990, com a instauração do Estatuto da Criança e do Adolescente, ECA. Este, que, além de modificar a forma de direito e justiça sobre e para essa “nova clientela”, em finais dos anos 1990, também modificou a expressão “menor” para a de criança e adolescente, significando maiores tentativas e propriedades de entendimentos, cuidados, direitos e deveres para o pleno desenvolvimento dos mesmos em sociedade.

CONFLICTS AND RELATIONS OF POWERS BETWEEN JUSTICE AND SEXUAL GENDERS: THE MINOR SEDUCTION CRIME WITHIN THE BRAZILIAN LEGAL LITERATURE - 1940-1990

This essay is part of my master's research, which analyzes, through seventeen procedural sources, filed in the collection of the Center for Documentation and Research Support? CEDAP, located at UNESP / Assis-SP, the crime of seduction of minors occurred between 1940, with the advent of the Penal Code, until the year 1990, with the establishment of the Child and Adolescent Statute, ECA. This, which, in addition to modifying the form of law and justice on and for this “new clientele”, in the late 1990s, also modified the expression “minor” for that of children and adolescents, meaning greater attempts and understanding properties, care, rights and duties for their full development in society.
